There is the nontrivial harm or evil constraint, the wrongfulness constraint, the desert constraint, and the presumption against criminalization (which Husak distractingly calls the 'burden of proof constraint'). Husak's secondary goal is to situate this endeavor in criminal theory as traditionally construed.
